These Terms and Conditions (the “Agreement”) govern your use of the web hosting services provided by NameSwamp.com. By activating an account, you agree to be bound by the following terms.

Section 1: The Service Packages

NameSwamp.com provides four standardized hosting tiers and one custom solution. All plans (except where noted) include a 14-Day Money-Back Guarantee, Free SSL Certificates, 300% Green Energy Match, and 1 Tree Planted per client.

A. Puddle Hosting (Best for Starters)

  • Target: Small websites (5–15 pages).

  • Resources: 1 Domain, 10 GB SSD Disk Space.

  • Bandwidth: Limited to 10 GB per client.

  • Bonuses: Daily Backups, Rank Math SEO PRO, Elementor ONE, Image Optimization, Site Accessibility, and Email Deliverability tools.

B. Creek Hosting (Best for Growing Sites)

  • Target: Medium websites (15–40 pages) with basic e-commerce or software integration.

  • Resources: 1 Domain, 25 GB SSD Disk Space.

  • Bandwidth: Unmetered Traffic.

  • Bonuses: Includes all premium software and Daily Backups.

C. River Hosting (Best for E-commerce)

  • Target: Large websites (40–65 pages) with advanced e-commerce or heavy software integration.

  • Resources: 1 Domain, 50 GB SSD Disk Space.

  • Bandwidth: Unmetered Traffic.

  • Bonuses: Includes all premium software and Daily Backups.

D. Delta Hosting (Enterprise Level)

  • Target: Massive websites (65–80+ pages) requiring maximum resources.

  • Resources: 1 Domain, High-capacity SSD Disk Space.

  • Bandwidth: Unmetered Traffic.

  • Bonuses: Includes all premium software and Daily Backups.

E. Swamp Yard (Custom Tier)

  • Target: Bespoke needs for high-traffic or specialized requirements.

  • Resources: NVMe SSD Custom to size; traffic custom to monthly needs.

  • Guarantees: 30-Day Money-Back Guarantee (exclusive to Custom tier).

Section 2: Guarantees & Uptime

  • Uptime: NameSwamp guarantees a 99.9% Network Uptime. If uptime falls below this threshold due to internal server failure, clients may be eligible for service credits at the Company’s discretion.

  • Money-Back Guarantee: Basic, Pro, Powered, and Juggernaut plans are subject to a 14-day refund window. Custom plans have a 30-day window. Domain registrations and third-party software licenses are non-refundable.

Section 3: Resource Usage & “Unmetered” Policy

  • Unmetered Traffic: Traffic must be within the scope of normal website operation. Hosting may not be used as a file-sharing repository, mirror site, or for excessive streaming that degrades server performance.

  • Disk Space: SSD space is for website files, databases, and emails only. It is not for offsite data storage or non-website related backups.

Section 4: Domain Registration

Domain names are registered through third-party registrars. While NameSwamp provides free Privacy Protection ($9.99 value), the user is responsible for accurate WHOIS data and domain renewal unless auto-renew is active.

Section 5: Included Software Licenses

Licenses for Rank Math SEO PRO, Elementor ONE, and other tools are valid only while the hosting account is active and in good standing.

Section 6: Backups and Data Loss

Daily Backups are a courtesy. The Company is not liable for data loss. Clients are strongly encouraged to maintain independent off-site backups.

Section 7: Prohibited Content

Users may not use servers for:

  • Phishing, malware distribution, or spam activities.

  • Infringement of intellectual property/copyrighted material.

  • Any activity violating the laws of the server’s jurisdiction.

Section 8: Limitation of Liability

NameSwamp is not responsible for any claimed damages, including incidental or consequential damages, arising from server downtime or unavailability.

Section 9: Post-Expiration Recovery & Data Retention (The 30/60/90 Rule)

If a hosting service is not renewed by the invoice due date, the account will be suspended. To restore data, a Reclamation Fee applies based on the days elapsed:

  • 9.1 Administrative Effort: Fees cover manual labor for archive retrieval and server re-provisioning.

  • 9.2 Permanent Deletion: After 90 days of non-payment, the account is permanently purged.

  • 9.3 Domain Recovery: Domain recovery is subject to separate registrar fees independent of NameSwamp.

Section 10: “The Swamp Vault” (Storage-Only Maintenance)

This plan allows clients to deactivate their live site but retain all data (files, databases, and mailboxes). This disables public access while preserving a snapshot.

  • 10.1 Service Limitations: Your website will display a “Parked” page; incoming emails will not be received.

  • 10.2 Re-Activation: Upgrading back to active hosting requires a one-time $25.00 Re-Activation Fee.

  • 10.3 Backup Integrity: Daily backups are reduced to Weekly Snapshots while in the Vault.
